What counts as a mobile food establishment
The FDA Food Code treats a mobile food establishment as a food establishment that operates from a vehicle or cart and moves, rather than as a separate category with lighter rules. Chart 4-D of the Food Code, the Mobile Food Establishment Matrix, exists specifically as a plan review and inspection guide for these units, and it explicitly notes that mobile units may also be subject to all Food Code provisions that apply to food establishments.
The matrix sorts requirements into three columns based on what you sell and whether you prepare it on board: time/temperature control for safety (TCS) food prepared on the truck, TCS food sold prepackaged, and non-TCS food prepared on board. If you sell both prepackaged TCS food and TCS food prepared on board, the more stringent column applies. This is why two trucks parked next to each other can face genuinely different requirement sets. A shaved ice cart and a taco truck are not inspected against the same list.
One useful edge case: the Food Code's definition of "food establishment" does not include an operation offering only prepackaged foods that are not TCS. A cart selling nothing but sealed bags of chips sits outside much of this framework, though your local authority still decides that in practice.
The servicing area is part of the inspection
This is the rule that catches new operators. The Food Code defines a servicing area as an operating base location that a mobile food establishment returns to regularly for things like vehicle and equipment cleaning, discharging liquid or solid wastes, refilling water tanks and ice bins, and boarding food.
The servicing area is not optional paperwork. It is a physical place the regulatory authority can inspect, and the Food Code sets requirements for it directly. Servicing areas must be provided with overhead protection, except for areas used only to load water or discharge sewage and other liquid waste through a closed system of hoses. Floors in mobile food establishment servicing areas must be nonabsorbent, the same standard applied to walk-in refrigerators and warewashing areas.
Whether you are required to have a commissary or servicing area at all is a local decision. The Food Code's own guidance says the regulatory authority's decision to require auxiliary support services such as a commissary or servicing area should be based on the menu, the type of operation, and the availability of on-board or on-site equipment. A truck that does all prep on board with full on-board equipment may face a lighter requirement than one that preps off-site. Ask your health department before you sign a commissary agreement, and ask again if you change your menu.
Water tank rules that only apply to trucks
The potable water side of a mobile unit has its own short list of specifications, and inspectors know them by heart because they are easy to check with a tape measure.

The inlet diameter rule and the dedicated hose fitting exist for one reason: to make it physically awkward to connect your drinking water hose to anything else, or anything else to your drinking water tank. Backflow into a potable tank is the failure mode these rules are built around, and the Food Code separately requires that a person operate the tank, pump, and hoses so that backflow and other contamination of the water supply are prevented.
The "periods of nonuse" clause in the flushing requirement is the one seasonal operators miss. A truck that sat over the winter needs its tank, pump, and hoses flushed and sanitized before it goes back into service, not just rinsed out.
Waste tank rules, including the 15 percent rule
The sewage holding tank in a mobile food establishment must be sized 15 percent larger in capacity than the water supply tank, and it must be sloped to a drain that is 25 mm (1 inch) in inner diameter or greater, equipped with a shut-off valve.
The 15 percent margin is deliberate. Everything that goes into the fresh tank has to come back out somewhere, and a waste tank sized exactly equal to the supply tank will overflow the moment anyone adds ice melt, spilled beverage, or wash water from something that did not start in the fresh tank. Undersized waste tanks are a common plan review rejection, and they are expensive to fix after a build.
Disposal is regulated as tightly as capacity. Sewage and other liquid wastes must be removed from a mobile food establishment at an approved waste servicing area or by a sewage transport vehicle, in a way that does not create a public health hazard or nuisance. A tank for liquid waste retention must be thoroughly flushed and drained in a sanitary manner during the servicing operation. Dumping gray water into a storm drain, a parking lot, or a landscaping bed is the violation that most reliably ends a day of trading early.
Handwashing on a moving kitchen
The Food Code requires at least one handwashing sink, plus however many are necessary for convenient use by employees and not fewer than the number required by law. On a truck, "convenient use" is the operative phrase. A sink that is blocked by a cooler, used as a prep basin, or not supplied with hot water and soap is treated as absent.
A handwashing sink on a mobile unit needs to be supplied from the potable tank, drain to the waste tank, and be reachable without leaving the food preparation area. Because trucks are small, the practical failure is not the absence of a sink but its conversion into storage during a busy service. Inspectors look for that specifically. Temperature control when the kitchen is moving
Holding requirements do not soften because the kitchen has wheels. TCS food must be held at 57°C (135°F) or above, or at 5°C (41°F) or less, with narrow exceptions for roasts and for time used as a public health control.
Trucks fail this more often than restaurants for three structural reasons. Generators fail or run out of fuel, and a cold hold unit that loses power for an unknown period leaves you unable to prove the food stayed at temperature. Ambient heat in a closed metal box in summer pushes cold-holding equipment past its design capacity. And transit itself is unmonitored time: food loaded at the commissary and driven across a city is in the danger zone the entire way unless it is actively held.
The defensible answer is measurement, not assumption. Log temperatures at load-out, on arrival, and through service, and treat any unexplained power gap as a decision point rather than something to reason around after the fact. The pre-operational inspection is the one you can fully control, because it is scheduled and it tests fixed things. Who has to be certified
Under the Food Code, the person in charge must be a certified food protection manager who has shown proficiency through passing a test that is part of an accredited program. The Code also allows a regulatory authority to exempt certain establishment types it deems to pose minimal risk.
For a food truck, this usually means the owner-operator is the person in charge and needs the certification personally, because there is no back office to delegate it to. If you run more than one truck, each unit needs a person in charge present, which in practice means more than one certified person. A Certified Food Protection Manager credential earned through an accredited program is portable between your units and generally between jurisdictions, though acceptance is always the local authority's call.
